Short-term rental rules · Del City, Oklahoma

Short-term rentals in Del City, explained properly.

The City of Del City requires an annual residential short-term rental license, issued by the Community Development Department under Article XV of Chapter 10 of its Code of Ordinances. The initial license costs $150 and each annual renewal $100; licenses expire June 30 each year or immediately on a change of ownership. Applicants must show an Oklahoma sales tax permit (or a third-party agent that collects the tax), a notarized safety affidavit and floor plan, proof of ownership and their advertisement URLs, and must supply a certified list of owners within 300 feet, who are notified and can object, which triggers a planning commission hearing. The article is subject to any overlay district or zoning restriction for an area or parcel. A violation carries a fine or deferral fee of up to $750 and/or up to 60 days in jail, and each day is a separate offense. We haven't reviewed the zoning use tables or the City's Chapter 20 taxes yet, so confirm zoning before you buy.

License and fees

License fees, renewal and late fee$150 initial license; $100 annual renewal; renewal grace period July 1 to August 1; renewals filed after the grace period carry a $100 late fee [1] Clause

Sec. 10-602(2) sets these amounts. Licenses expire June 30 each year, and a renewal application is filed with the community development department. The amounts are those in the Code as adopted by Ordinance 1421 (February 5, 2024); the Code is shown as codified through Ordinance 1459 (July 6, 2026). Any separate fee schedule or resolution outside the Code hasn't been reviewed.

Does the license transfer to a new owner? No: the license expires immediately on a change of ownership [1] Clause

Sec. 10-602(2) provides that a residential short-term rental license expires on June 30 each year or immediately upon change of ownership. The application process is in Sec. 10-603; a transfer procedure is not shown here.

Is an Oklahoma sales tax permit required for the license?Yes: no license is issued or renewed until the applicant produces sales tax permits issued by the State of Oklahoma or evidence that a third-party rental agent collects the tax [1] Clause

Sec. 10-602(3) sets this condition for issuing or renewing a license. The application must also include a certificate of registration with the City Clerk's Office under Article III of Chapter 20 (Taxation) (Sec. 10-603(1)(g)). Article III of Chapter 20, the City's taxes on lodging or rentals, hasn't been reviewed for this page, so City tax rates are not shown here.

Delinquent City taxes and code violationsA license is not issued or renewed while Chapter 20 Article III taxes are delinquent or the property is in violation of the Code; a renewal waits until the violation is resolved by final court disposition or the building code official certifies compliance [1] Clause

Sec. 10-602(4) sets these conditions. For a property in violation of the Del City Code of Ordinances, no renewal is issued until the violation is resolved through final disposition of a prosecution filed in the Municipal or District Court, or on certification by the building code official that the property is in compliance with applicable codes.

Application and notice

Application contents and attachmentsThe application lists the owner's contact details, the street address, the bedroom count, a notarized safety affidavit with a floor plan, proof of ownership, the advertisement URLs, a certified list and stamped envelopes for owners within 300 feet, and the City Clerk registration [1] Clause

Sec. 10-603(1) requires a form from the Community Development Department with: (a) the owner's name, mailing address and telephone number and the property's street address; (b) the number of bedrooms offered; (c) verification of working smoke detectors, a working carbon monoxide detector and a functioning fire extinguisher, met by a signed and notarized affidavit and a floor plan showing the rooms for rent and the location of the detectors and extinguishers; (d) proof of ownership; (e) the URL of every advertisement; (f) a typewritten list of all property owners within 300 feet, with mailing labels on stamped City-addressed envelopes, certified by the Oklahoma County Assessor, a licensed abstractor, attorney, engineer or architect and prepared no more than 30 days before submission; and (g) a certificate of registration with the City Clerk's Office under Article III of Chapter 20.

Neighbor notice and objection hearingThe City mails notice to owners within 300 feet; a written objection within 30 days sends the application to a planning commission public hearing, whose decision can be appealed to the city council within 10 days [1] Clause

Under Sec. 10-603(2) the Community Development Department sends notice of the application to each owner on the applicant's list and documents it with a certificate of mailing. If no written objection is received within 30 days of the mailing, the department may issue the license, provided the requirements of Secs. 10-602 and 10-603 are met. If a written objection is received within 30 days, the application goes on a planning commission agenda and a public hearing is held. A final decision of the planning commission may be appealed to the city council by filing notice with the city clerk within 10 days of the action.

Operating rules

What counts as a residential short-term rental?Any dwelling, or portion of one, for rent for a temporary period of up to 30 consecutive days per guest within a 90-day period [1] Clause

Sec. 10-601 gives this definition and also defines a guest (a person who rents or occupies with others a residential short-term rental) and rent (all payments except deposit and damages for temporary occupancy). The definition is used for the licence requirement in Sec. 10-602.

Which parts of a property may be rented?Only space approved for residential occupancy; a vehicle parked on the property, a storage shed, trailer, garage or temporary structure such as a tent may not be offered or used [1] Clause

Sec. 10-602(5) bars offering or engaging in a residential short-term rental in or on any part of the property not approved for residential occupancy, including a vehicle parked on the property, a storage shed, trailer or garage, or any temporary structure such as a tent.

Building and fire code complianceA rental must comply with applicable building and fire codes, and the application needs a notarized affidavit that the dwelling has working smoke detectors, a working carbon monoxide detector and a functioning fire extinguisher [1] Clause

Sec. 10-602(6) bars offering or engaging in a residential short-term rental without complying with applicable building or fire codes. Sec. 10-603(1)(c) sets the affidavit and the floor plan showing the location of the rooms for rent, smoke detectors, carbon monoxide detector and fire extinguishers.

Enforcement

License suspension or revocationThe City may suspend or revoke a license for unpaid Chapter 20 Article III taxes or for violating the Code or state law, after written notice and a planning commission public hearing; the decision can be appealed to the city council within 10 days [1] Clause

Sec. 10-604(1) lets the planning commission order suspension or revocation on a preponderance of the evidence that the violation occurred, after the owner or operator has had written notice of the violations and a public hearing. Sec. 10-604(2) directs the city manager or designee to establish written procedures for complaints about residential short-term rental properties; those procedures are not part of the Code text reviewed here.

Penalty for violationsA fine or deferral fee in lieu of fine of up to $750 and/or up to 60 days in jail, plus costs, for each violation; each day of operating in violation is a separate offense [1] Clause

Sec. 10-606 sets the penalty for each violation of the article. Because each day a residential short-term rental is operated in violation is a separate offense, the penalty can apply to each day.

State law that also applies

Oklahoma state sales tax on rooms4.5% state sales tax on the service of furnishing rooms by hotels, motels, public rooming houses, public lodging houses and similar places; local sales taxes generally apply to the same items [2] [3] Clause 1 Clause 2

Section 1354(A)(7) of Title 68 of the Oklahoma Statutes levies an excise tax of 4.5% of the gross receipts or gross proceeds from the service of furnishing rooms by a hotel, apartment hotel, public rooming house, motel, public lodging house or tourist camp, unless the sale is exempted in the Oklahoma Sales Tax Code. The Oklahoma Tax Commission says the state sales and use tax rate is 4.5%, that local taxes may also apply, and that, except for residential utilities and certain food, local taxes apply to the same taxable items and services as the state tax; it also lists lodging among the transactions the state sales tax levy covers. The statute and the Commission's answers read do not say in so many words whether a private home or room rented for short stays is a "public lodging house"; owners should confirm their filing duty with the Commission. City and county rates are shown on each place's page.

Do booking platforms collect the state tax?Platforms with at least $10,000 a year of Oklahoma taxable sales must elect either to collect and remit sales tax or to meet notice and reporting requirements; the Tax Commission says platforms selling Oklahoma lodging may now have to collect state and local taxes [4] [5] [3] Clause 1 Clause 2 Clause 3

Under sections 1391 and 1392 of Title 68, a marketplace facilitator is a business that lists or advertises a marketplace seller's products and, directly or through others, collects the buyer's payment and passes it to the seller. Since Senate Bill 1339 (effective January 1, 2023), "product" includes services and other transactions taxable under the Sales Tax Code, but not a hotel or motel built with more than 12 rooms. A facilitator with at least $10,000 of taxable Oklahoma sales in the previous 12 months must file an election each year with the Tax Commission either to collect and remit the tax or to comply with notice and reporting requirements; one that elects to collect must get a sales tax permit, and its collection duty also covers local sales taxes administered by the Commission. The Tax Commission says marketplace facilitators making sales of Oklahoma lodging may now be required to collect and remit state and local taxes. Which election a given platform has made is not stated in these sources; check with the platform. City hotel or lodging taxes are separate and shown on each place's page.

State Department of Health hotel licenseState law requires a license from the State Commissioner of Health to operate a "hotel", which includes any place where sleeping accommodations are furnished for pay to transient guests if five or more rooms are available for them [6] Clause

Section 1-1201 of Title 63 of the Oklahoma Statutes makes it unlawful to operate or maintain a hotel without a license from the State Commissioner of Health, which (unless a rule says otherwise) expires each June 30 and carries an annual fee set by the Commissioner. For this section, "hotel" includes any hotel, motel, tourist court, apartment house, rooming house or other place where sleeping accommodations are furnished or offered for pay to transient guests, if five or more rooms are available for transient guests. The statute does not say how the Department applies this to a house or apartment rented short-term; owners renting five or more rooms should check with the Oklahoma State Department of Health.
