Short-term rental rules · Clear Creek County, Colorado

Short-term rentals in Clear Creek County, explained properly.

Clear Creek County requires a County short-term rental license before an STR (a rental of a dwelling, unit or room for fewer than 30 consecutive days) may be advertised or operated in unincorporated Clear Creek County. Ordinance 19 was adopted December 17, 2024, took effect immediately and replaced the earlier STR rules. Standard licenses are capped at 4.5% of the county's residences and carry a spacing rule; Primary Residence licenses (Occupied or Seasonal) have no cap, and the Seasonal license allows 90 rental days in a license period. The fee schedule (Resolution R-24-92, December 10, 2024) lists a $1000 Standard license fee and a $500 Primary Resident fee, plus other charges. Each STR needs a 24-hour responsible agent who responds within an hour, and violations carry fines of $250, $750 and $1,000. We haven't reviewed the Clear Creek County Zoning Regulations, so confirm zoning with the County before you buy. The County's page invites public feedback on Ordinance 19.

License types and limits

Is there a limit on rental days for a Primary Residence - Seasonal license?Yes: the residence may not be rented more than 90 days in a license period; licenses issued during calendar year 2025 only could rent up to 120 days, and that exception does not carry over to licenses issued or renewed after 2025 [1] [2] Clause 1 Clause 2

Accessory dwelling units are not eligible for the Seasonal license, and monitoring software may be used to verify compliance. The County's Short Term Rentals page still describes a 120-day limit in a one-year license period; the Ordinance text sets 90 days after 2025, and this page follows the Ordinance.

Can an accessory dwelling unit (ADU) be licensed as an STR?Conditional: a permitted ADU can get a Primary Residence - Occupied STR license if it shows a legal water supply and can follow Colorado Division of Water Resources Guideline 2016-1; ADUs are not eligible for a Primary Residence - Seasonal license [1] [2] Clause 1 Clause 2Confirming

The Ordinance lets a license holder live on a property with a permitted ADU and obtain a Primary Residence STR License for the ADU, or the reverse. The County's page says accessory dwelling units cannot be rented per Guideline 2016-1, which reads differently from the Ordinance, so we are treating this rule as unsettled until the County clarifies.

Can a yurt, tent, RV or camper be used as an STR?No: yurts, tents and other tent-type structures, primitive structures, recreational vehicles, campers and other temporary structures are not permitted to be used as STRs [1] Clause

Guests also may not stay overnight in motor vehicles, recreational vehicles or camping vehicles parked at an STR.

Can an STR license be transferred to a new owner?Conditional: ownership of a license may not be transferred unless one of the listed exceptions applies (for example a transfer to an immediate family member for no consideration, to the grantor's own trust, or to an entity in which the grantor keeps a controlling interest) [1] Clause

Other exceptions cover joint-tenancy changes between the same parties, transfers by death, corrective or boundary-adjustment transfers, and court-ordered or separation-related transfers. If the majority interest is no longer held by the party who obtained the license, a new license is needed. Either before or within 30 days after a transfer, the new owners must contact the Review Authority with the materials needed to decide whether the transfer is exempt.

How long does an STR license last and how is it renewed? One year from the date the initial license was issued; a renewal application must be submitted at least 30 days before expiration, within the renewal period set by the Review Authority [1] Clause

A renewal not submitted at least 30 days ahead is treated as expired one year from the initial issue date. If there is an open building or OWTS permit for an upgrade, remodel or demolition, the license stays in effect subject to renewal but no rentals may occur until the permit has all final approvals. Non-compliance, or multiple credible or validated complaints in the most recent calendar year, are grounds for non-renewal or revocation.

Operating rules

Is liability insurance required?Yes: proof of home-share or short-term rental insurance with comprehensive liability coverage for property damage, theft and bodily injury to guests is part of the application [1] [2] Clause 1 Clause 2

The County's page says the coverage is usually a short-term rental specific policy or a commercial policy, may not be available on a standard homeowner's policy, and that AirCover is not acceptable. The owner must keep the insurance in place for the STR.

Is a safety inspection required?Yes: the STR must pass annual safety inspections, or provide other evidence of adequate safety, as determined by the Chief Building Official before the license is issued [1] [2] [3] Clause 1 Clause 2 Clause 3

The County's page says the application requires certifying that certain Building Safety elements are in place and that the Chief Building Official will require an inspection to verify them. The Ordinance also requires a fire extinguisher, smoke alarms and carbon monoxide alarms. The fee schedule lists a $150 safety inspection fee.

Is evidence of a legal water supply and sewage treatment required?Yes: the application must include evidence of a legal water supply and of a sewer connection or an adequate County-approved onsite wastewater treatment system for the number of occupants proposed [1] [2] Clause 1 Clause 2

For a well or septic system, evidence can be the current well permit and onsite wastewater treatment system (OWTS) permit. The County says an unsuitable or undocumented system may need upgrading or replacement.

Is a responsible agent required?Yes: each owner must designate a responsible agent (the owner may serve) who is available 24 hours a day, seven days a week and must respond to a complaint within an hour [1] Clause

The agent must have access and authority to manage the unit, must be registered with the Clear Creek County alert system, and must tell renters about current fire restrictions. Adjacent property owners within 300 feet of the parcel must be given written notice of the 24-hour contact person. The agent's contact information may be made available to the public.

What guest occupancy limits apply? Two occupants per sleeping room unless the Review Authority decides otherwise; on an onsite wastewater system the limit is the capacity on the OWTS permit; on central sewer, two people per legal bedroom plus two more per residence [1] Clause

Occupant load at any time may not exceed one person per 200 square feet of conditioned home area or the calculated guest load, whichever is greater. The maximum number of overnight guests must be communicated to guests. The fee schedule lists a $200 per-occupant fee for STRs over four occupants.

What parking rules apply?Off-street parking of one space per bedroom; on-street parking within a County road, right-of-way or private road right-of-way is prohibited [1] Clause

A shared driveway requires written permission from each shared-driveway owner, and parking on neighboring properties needs written owner permission. The owner must also provide snow storage and a snow removal plan for continuous access.

Are fires, outdoor cooking and fireworks allowed at an STR?No: open burning fueled by any source is not permitted, including campfires, fire pits and charcoal braziers, and outdoor cooking with propane, natural gas, charcoal or any other fuel is not permitted; discharging firearms or fireworks on the premises is prohibited [1] Clause

Existing outdoor fire or cooking facilities must be removed or, if permanent, blocked off so they cannot be used. Defensible space is required for all STR properties, to the standard for new construction under the building code, before a license is issued.

Do private covenants or HOA rules still apply to an STR?Yes: the Ordinance does not allow an STR that private covenants prohibit, and the County may suspend or revoke a license when a homeowners' association petitions and the STR is prohibited under bylaws or agreements registered with the Colorado Division of Real Estate [1] Clause

Covenants are privately enforced according to their terms.

Must online listings show the County license number?Yes: any listing for an STR on a vacation rental service must include the County license number, and a platform must remove a listing within seven days after the County notifies it that the license is invalid, expired or revoked [1] Clause

This follows C.R.S. 30-15-401(1)(s)(III). The County's notice to the platform includes the listing URL and the reason for removal.

Fines & enforcement

What are the fines for violations?Violations are a civil infraction with a graduated fine schedule: first $250, second $750, third or more $1,000; each day a violation continues is a separate offense, and fines may be waived if violations are rectified quickly and properly [1] Clause

An STR operating without a license may be issued a Notice of Violation and must stop operating and advertising immediately, and the later application fee is two times the adopted licensing fee. Unresolved non-compliance or multiple credible or validated complaints can lead to suspension or revocation, which can be appealed to the County Manager within 10 days of notice, then to the Board of County Commissioners. A single egregiously harmful violation can support immediate revocation.

State law that also applies

State sales tax on short stays2.9%, plus any local sales taxes the state collects [4] [5] Clause 1 Clause 2

Colorado charges its 2.9% state sales tax on the entire amount charged for rooms and accommodations. A stay may also owe local sales taxes that the Colorado Department of Revenue collects for counties and special districts, and any sales tax of a home-rule city that collects its own tax (see below).

Which stays are taxed?Stays of less than 30 days [5] Clause

State sales tax does not apply to a room or accommodations rented to a person who is a permanent resident of it and has a written agreement to occupy it for at least 30 consecutive days. Shorter stays are taxed.

Colorado sales tax license required?Yes, unless you rent only through a booking platform that collects the state-collected taxes for you [5] [4] Clause 1 Clause 2

The Colorado Department of Revenue says anyone who offers rooms or accommodations for rent must get a Colorado sales tax license and collect sales tax on taxable rentals. A seller who makes sales only through a marketplace may be exempt from licensing, collection and filing if the marketplace collects all state and state-administered local sales taxes for them. The license costs $16 (prorated) plus a $50 deposit, a separate license is needed for each business location, and licenses expire on December 31 of odd-numbered years.

Do booking platforms collect state taxes?Yes, for state-collected taxes [5] Clause

For rooms rented through a marketplace (including online platforms), the marketplace facilitator must collect and remit the state sales tax and the local sales taxes the state collects, plus any county lodging tax and local marketing district tax. City taxes in home-rule cities are separate (see below).

City lodging and home-rule city taxesPaid to the city, not the state [5] Clause

The Colorado Department of Revenue does not administer any lodging tax imposed by a city or town, and it does not collect sales tax for home-rule cities that collect their own. Those taxes are licensed, filed and paid with the city.

County lodging and local marketing district taxesSet by some counties and districts; filed with the state [5] Clause

Colorado counties may add a county lodging tax, regional transportation authorities a visitor benefit tax, and local marketing districts a marketing tax on rooms subject to state sales tax. County lodging and visitor benefit taxes are filed quarterly with the Department of Revenue on form DR 1485; the Department's DR 1003 publication lists the rates.
